1. Scope of Services

LEADSPILOTS LLC (the "Company") agrees to provide lead generation and related support services to the Client, with the goal of delivering qualified, interested, and exclusive seller or real estate opportunity leads tailored to the Client's selected market, plan level, and operational needs.

The selected Team Plan includes 72 qualified leads for a minimum of 2 counties and up to 8 counties during the applicable service period. The Company is a marketing and support provider and is not a real estate company, mortgage lender, bank, escrow holder, title company, settlement agent, or financial adviser. The Client remains responsible for licensure, agency disclosures, lawful follow-up, fair housing compliance, and all real estate services provided to prospects.

2. Payment Terms

The Client shall pay a refundable sign-up fee of $1800 upfront upon signing this Agreement.

The total sign-up fee of $1800 will be reimbursed or deducted by the Client upon the first successful closing generated from a lead provided under this Agreement.

Referral Fees: The Broker/Agent agrees to pay the Company a 8% referral fee from the Realtor's net commission, meaning the amount the Realtor takes home after the broker's split, for any real estate transaction, buying or selling, that occurs through the provided leads during the marketing coverage period.

3. Lead Delivery

The Company will deliver the first lead within the first month after completion of onboarding and execution of this Agreement, subject to timely Client onboarding, market availability, compliance review, and campaign readiness.

The Company will deliver 72 exclusive seller or real estate opportunity leads over a period of 365 days for the Client's approved target market of a minimum of 2 counties and up to 8 counties. Lead/call recording is included where permitted by law and with legally sufficient notice.

Each provided lead must meet the following criteria to be deemed qualified:

  • Located within the Client's approved target market and selected county coverage.
  • Expresses a clear real estate interest, including potential selling, buying, valuation, listing, or consultation intent within the campaign qualification window.
  • Is reasonably identified as the legal owner, prospective client, or authorized decision-maker where applicable.
  • Has provided consent or lawful permission to be contacted through the applicable lead generation or qualification process.
  • Is not knowingly duplicated from a prior Company delivery for the same Client during the active agreement period.

Any lead found invalid, a non-homeowner where ownership is required, uninterested, outside the approved territory, or unreachable after three reasonable attempts within seven (7) days may be submitted for review and, if approved, replaced by the Company within the contract period upon the Client's written rejection and supporting notes.

4. Client Responsibilities

  • The Client is responsible for timely follow-up and professional engagement with each lead.
  • The Client must maintain active communication with the Company and provide feedback on lead quality, lead outcomes, and territory performance.
  • The Client must complete onboarding, provide accurate target market information, and maintain a valid real estate license or lawful authority to act in the selected market.
  • The Client must comply with TCPA, CAN-SPAM, DNC, Fair Housing Act, privacy, consumer-protection, licensing, advertising, and state-specific real estate requirements.
  • The Client must promptly notify the Company of any change in license status, contact information, payment authority, service territory, or authorized representative.

5. Agreement Duration, Refunds & Disputes

Refund Policy: The Client may submit a written request for a refund within thirty (30) days from the date of execution of this Agreement, solely in the event of non-fulfillment of lead delivery as specified in the Lead Delivery section and provided the Client has fulfilled all Client Responsibilities. If deemed eligible, the Client may receive a partial refund, pro-rated credit, or other written remedy determined by the Company based on the undelivered portion of the contracted service.

Refund & Dispute Eligibility: After the initial thirty (30) day period, the Client will no longer be eligible to request a refund or initiate a payment dispute under this Agreement except as otherwise required by applicable law or expressly agreed in writing by the Company.

Agreement Validity: This Agreement shall remain valid for 1 year from the date of signing or completed onboarding, unless extended, suspended, or terminated in writing. Timelines may be adjusted for Client delay, incomplete onboarding, market availability, compliance review, holiday observance, or temporary territory capacity limits.

6. Support & Additional Services

Dedicated Support: Includes up to ten (10) hours of support per day during the service period. Lead portal access, live hot transfers, monthly reporting, and team-level dedicated account management are included during the service period.

Additional Services:

  • Lead tracking access through the Leads Pilots member dashboard.
  • Lead/call recording where permitted by law and with legally sufficient notice.
  • Priority based appointment scheduling support.
  • Live hot transfer support where operationally available and legally permitted.
  • Monthly performance reporting.
  • Team of dedicated account managers for account coordination.

Limitations:

  • Digital marketing services are not included unless separately agreed in writing.

7. Holiday Observance

LEADSPILOTS LLC observes national public holidays in the United States. Support and services may be delayed or paused on these days, with timelines adjusted accordingly. Urgent assistance requests on these holidays will be addressed on the next business day unless otherwise agreed. If the Company intends to take additional time off outside of national holidays, the Company will provide reasonable advance notice to help preserve continuity of services.

8. Confidentiality

Both parties agree to maintain the confidentiality of proprietary, business, lead, payment, campaign, account, and customer information shared during the course of this Agreement. Neither party shall disclose confidential information to any third party without written consent of the other party, except to authorized personnel, service providers, legal advisers, payment processors, regulators, or as required by law.

9. Payment Authorization

By submitting payment for this plan, the Client authorizes LEADSPILOTS LLC to process the agreed amount through its secure, PCI-compliant payment processor for the services described in this Agreement. The Client understands that card or bank details are entered directly through the processor's secure platform and are not stored or handled by LEADSPILOTS LLC on this website. This authorization confirms the Client's approval of the transaction and acknowledgement of the payment terms outlined herein.

10. Disclaimers & Limitation of Liability

Services are provided on an "AS IS" and "AS AVAILABLE" basis. LEADSPILOTS LLC does not guarantee listings, closings, revenue, commissions, financing approval, property valuation, consumer creditworthiness, or any specific business outcome. To the maximum extent permitted by law, the Company's total aggregate liability shall not exceed the fees actually paid by the Client under this Agreement.

11. Entire Agreement

This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions, negotiations, proposals, representations, or agreements, whether written or verbal, relating to the subject matter herein. Any amendment must be in writing and accepted by both parties. This Agreement is governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.
